TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STAND OUT BOOKKEEPING LLC EACH IRREVOCABLY WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION IN CONNECTION WITH ANY DISPUTE ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE.
ALL DISPUTES MUST BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR SHALL HAVE NO AUTHORITY TO COMBINE OR AGGREGATE CLAIMS, CONDUCT ANY CLASS PROCEEDING, OR MAKE AN AWARD TO ANY PERSON OR ENTITY NOT A PARTY TO THE ARBITRATION.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or remedy actual or threatened infringement of intellectual property rights, misappropriation of confidential information, or other irreparable harm for which monetary damages would be an inadequate remedy. Nothing in this section shall prevent either party from bringing a small claims court action where jurisdiction is appropriate.
TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO MANDATORY ARBITRATION, YOU AND STAND OUT BOOKKEEPING LLC EACH IRREVOCABLY WAIVE THE RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY LEGAL PROCEEDING ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE.
We reserve the right to modify, suspend, or discontinue the Site or any portion thereof at any time, with or without notice, for any reason. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.
